Not every divorce is a battle. If you and your spouse agree on the major issues, an uncontested divorce in Tennessee can be completed relatively quickly — without years of litigation and attorney fees that drain both sides.
But "uncontested" doesn't mean simple. There are still requirements, paperwork, and deadlines that must be handled correctly or the process stalls.
What Makes a Divorce "Uncontested"?
A divorce is uncontested when both spouses agree on all major issues — division of property and debts, spousal support (if any), child custody, visitation, and child support. If there's genuine agreement on all of these, you may qualify for an uncontested divorce.
Tennessee's Waiting Period
Tennessee law requires a mandatory waiting period before a divorce can be finalized. If you have no minor children, the waiting period is 60 days from when the divorce complaint is filed. If you have minor children, it extends to 90 days. These waiting periods cannot be waived.
The Required Documents
An uncontested divorce in Tennessee typically requires several documents including a Complaint for Divorce, a Marital Dissolution Agreement (MDA), a Permanent Parenting Plan (if children are involved), and various financial disclosures. These documents must be filed with the Circuit or Chancery Court in your county.
The Marital Dissolution Agreement is the most important document — it spells out exactly how assets, debts, and responsibilities are divided. Getting this wrong creates problems that outlast the divorce itself.
Grounds for Divorce
Tennessee allows divorce on no-fault grounds — specifically, "irreconcilable differences." For an uncontested divorce, this is typically what both parties cite. You don't need to prove wrongdoing by either spouse.
What Can Go Wrong
The most common problems: incomplete financial disclosure, an MDA that doesn't account for all marital property, child support calculations that don't follow Tennessee guidelines, and filing errors that delay or invalidate the process.
Even in an uncontested divorce, one poorly drafted agreement can create enforcement problems for years. Taking the time to get the paperwork right protects both of you.
